The ToughStuff products were designed for use in developing countries by people who have no access to electricity. They may not work as well as other products sold in the United States. They may not work on all phones or music products. Please don’t be disappointed if they have limited use, because they weren’t made for the United States.

In making a donation to ToughStuff you agree to defend, indemnify and hold ToughStuff harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Site or use of our Products.

Shipping
Your products will be shipped within 2 weeks of ToughStuff receiving payment.

Guarantee
ToughStuff will replace any products that are faulty or broken upon receiving your delivery. You must inform ToughStuff of the broken products within two weeks of their shipping date. You must send us the broken products back to receive fixed products. We will not replace products that you broke. This guarantee is only available for two weeks following the shipping date.

Privacy Statement
At ToughStuff, we are committed to protecting your privacy. We do not sell or rent information about our customers. All information provided to ToughStuff remains absolutely confidential.

Carbon Credits
In making a donation to ToughStuff, you release any claim on any carbon credits or any financing from those carbon credits that make come from our products. We have priced our products cheaper in anticipation of received funding from selling our Carbon Credits. We need carbon credit financing to make our products affordable enough for our target market to purchase them.

ToughStuff is NOT a non-profit

Since ToughStuff is classified as a “social enterprise” your donations WILL NOT be tax deductible. ToughStuff exist to alleviate poverty in developing countries and to help protect the environment. We believe the best way to accomplish this goal on a broad scale is to operate as a business. By selling our products we’re able to help many more people than if we were dependent on donations alone to give products away. And every dollar invested in ToughStuff will be repaid and can be used again for other social causes.

IN NO EVENT SHALL TOUGHSTUFF BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, EVEN IF TOUGHSTUFF HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION, UNDER CONTRACT, NEGLIGENCE OR ANY OTHER THEORY, ARISING OUT OF OR IN CONNECTION WITH THE USE, INABILITY TO USE OR PERFORMANCE OF THE INFORMATION, SERVICES, PRODUCTS AND MATERIALS AVAILABLE FROM THE SITE. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OR THE EXISTENCE OF ANY LIMITED REMEDY.
